Compliance Legislation
If there is one thing three Federal Acts have in common, it is data availability. The use of computers in business has significantly increased the amount of data used by business to conduct and support their operations. Legislation has been enacted requiring companies to implement controls to safeguard their data and make it available when needed to comply with internal and external audits. The Acts in themselves cover a wide scope of regulations and compliance.

  • HIPPA (Healthcare Insurance Portability and Accountability Act of 1996)
    Generally, the Act sets standards for the protection and security of health data. It includes the requirement that healthcare providers implement a backup plan for their critical data. As part of this compliance, the act requires healthcare entities to provide for disaster planning that includes the physical safeguarding of their data.

  • Gramm-Leach-Bliley Act (The Financial Modernization Act of 1999)
    Among other items, the Act includes protection for consumer’s personal financial information by any entity involved with financial products or services. These include banks, lending, tax preparation, loan servicing, credit counseling, insurance, credit counseling, real estate settlement, credit reporting, securities and investments, and any other entity providing financial services or products. Covered entities must create, implement and maintain safeguards of their customers information.

    The media reported loss of customer financial data by one financial institution emphasized how insecure transporting backup tapes can be. The institution keeps an offsite backup by shipping tapes to another facility. In the reported case a particular shipment was lost.   • Sarbanes-Oxley Act 0f 2002
    Many will associate the enactment of this legislation as a result of large corporate scandals with compliance seen as a way to prevent a recurring of such events. The Act specifies auditing firms are required to maintain seven years worth of confidential documents relating to audit reports of companies covered by the act. Covered companies are required to maintain the availability of company confidential documents relating to these audits.
